Terms of Use for Datz Flood Monitoring Location-Based Services

Article 1 (Purpose)
These Terms of Use aim to define the rights, obligations, and responsibilities between Datz Co., Ltd. (hereinafter referred to as the "Company") and users regarding the use of the object location information and location-based services (hereinafter referred to as "Location Information Services") provided by the Company.
Article 2 (Effectiveness and Amendment of Terms)
- These Terms take effect when the user agrees to them and completes registration as a user of the Location Information Services through the procedures set by the Company.
- By clicking the “Agree” button, the user is deemed to have fully read, understood, and consented to the application of these Terms.
- The Company may amend these Terms to reflect changes in Location Information Services or other necessary purposes, provided such amendments do not violate relevant laws.
- In the event of amendments, the Company will notify users of the changes via its website or service announcements at least 15 days prior to the effective date. For significant changes that affect user rights, the Company will provide individual notifications via email (or, if unavailable, through in-app messages, notifications, or SMS) at least 30 days before the effective date.
- If a user does not explicitly reject the amended Terms within 7 days after the notification or implementation, they are deemed to have accepted the changes. Users who do not agree to the amendments may withdraw their consent to these Terms.
Article 3 (Supplementary Provisions)
Matters not stipulated in these Terms shall comply with relevant laws, including the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Telecommunications Business Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, as well as the Company's policies.
Article 4 (Content of Services)
The Company provides the following location-based services using location information collected from location information providers or directly collected object location information:
- Providing or recommending search results and content based on location information.
- Location sharing, notifications based on location/area, and route guidance for daily convenience.
- Content tagging for location-based classification.
- Customized advertisements based on location information.
Article 5 (Service Fees)
The location-based services provided by the Company are free of charge.
However, data charges incurred while using wireless services are billed separately according to the policies of the user’s mobile carrier.
Article 6 (Changes, Restrictions, and Suspension of Services)
- The Company may change, restrict, or suspend all or part of the Location Information Services due to policy or regulatory changes.
- The Company may restrict or suspend user access in the following cases:
a. Intentional or grossly negligent interference with service operations.
b. Unavoidable circumstances such as facility maintenance, repair, or construction.
c. Suspension of telecommunications services by a licensed telecommunications provider.
d. National emergencies, system malfunctions, or surges in service usage.
e. Other significant reasons deemed inappropriate for service continuation. - In such cases, the Company will notify users in advance through its website or other means.
Article 7 (Use and Provision of Personal Location Information)
- When providing location-based services using personal location information, the Company will notify users and obtain their consent.
- The Company will not provide personal location information to third parties without user consent. When providing such information to third parties, the Company will notify the user in advance and obtain their consent.
- When providing personal location information to a third party designated by the user, the Company will notify the user immediately via the collection device, email, or other specified communication methods. Exceptions include:
a. When the collection device lacks functionality to receive notifications.
b. When the user has predesignated an alternative communication method. - The Company will automatically record and retain confirmation data on the collection, use, and provision of location information for six months as required by law.
Article 8 (Retention and Purpose of Personal Location Information)
- The Company retains personal location information for the purposes specified in Article 4 and deletes it immediately after achieving those purposes.
- For services where location information is stored with user-generated posts or content, the information is retained for the duration of the post or content’s storage.
- The Company may retain personal location information for the minimum necessary period if required for service provision.
- Retention may also comply with other legal obligations or requirements under the Act on the Protection and Use of Location Information.
Article 9 (User Rights for Personal Location Information)
- Users may withhold consent for the use or provision of personal location information at any time.
- Users may withdraw consent for the use or provision of personal location information, in which case the Company will delete the corresponding data promptly.
- Users may request a temporary suspension of the use or provision of personal location information, and the Company will comply with such requests without objection.
- Users may request to access, review, or correct any data related to the use or provision of personal location information.
- Users can exercise these rights by contacting the Company via the contact details provided in Article 15.
Article 10 (Rights of Legal Guardians)
- For users under the age of 14, the Company will obtain consent from both the user and their legal guardian for the use or provision of personal location information.
- The legal guardian holds all rights specified in Article 9.
Article 11 (Rights of Custodians for Children Under 8)
- For children under 8 years of age, incapacitated individuals, or severely disabled persons, a legal custodian may provide consent for the use or provision of personal location information if necessary for their safety.
- Legal custodians must submit written proof of their status along with their consent.
- Legal custodians hold the same rights as users under Article 9.
Article 12 (Compensation for Damages)
Users may claim compensation from the Company if damages occur due to violations of location information-related laws. The Company is liable unless it proves the absence of intentional or negligent acts.
Article 13 (Disclaimer)
- The Company is not liable for service disruptions caused by:
a. Natural disasters or force majeure.
b. Deliberate interference by third-party service partners.
c. User negligence.
d. Other reasons beyond the Company's control. - The Company does not guarantee the reliability or accuracy of information provided through the services and is not liable for damages resulting from such content.
Article 14 (Dispute Resolution)
- The Company will sincerely cooperate with users to resolve disputes related to location information.
- If disputes remain unresolved, users or the Company may file for mediation with the Korea Communications Commission or the Personal Information Dispute Mediation Committee.
