Terms of Service for Datz Flood Monitoring Service

Effective Date: December 19, 2023


Chapter 1: General Provisions

Article 1 (Purpose)

These terms and conditions ("Terms") establish the rights, obligations, responsibilities, and other necessary matters between Datz Co., Ltd. (hereinafter referred to as the "Company") and users regarding the use of the flood monitoring services provided by the Company.


Article 2 (Definitions)

  1. The terms used in this agreement are defined as follows:
    a. "Service" refers to the flood monitoring services provided by the Company through web and mobile platforms, regardless of the device used (PCs, smartphones, or other wired or wireless devices).
    b. "User" refers to any individual who has entered into a service agreement with the Company under these Terms and is classified as follows:

    1. "Member": A user who has completed the membership registration process specified by the Company.
    2. "Non-Member": A user who uses the service without registering. Non-members may face restrictions compared to members.
      c. "Content" includes all images, text, information, data, and other materials provided in connection with the service.
      d. "Flood Monitoring App" refers to the application developed by the Company for flood monitoring, featuring water level measurement, notifications, complaint management, and other related functionalities. The app is available on web, iOS, and/or Android platforms.
      e. "ID" means the email address or other combination of characters, numbers, or symbols chosen by the user and approved by the Company for user identification and service access.
      f. "Password" refers to a combination of characters, numbers, or symbols set by the user to verify their identity as the rightful owner of the ID.
  2. Any terms not defined in this agreement shall be interpreted in accordance with relevant laws, the Company's Privacy Policy, other Company policies, and general business practices.


Article 3 (Scope of Terms)

  1. These Terms apply to all users of the Service. However, some provisions may not apply to non-members as specified in these Terms.
  2. These Terms take effect from the date the user agrees to them and remains in effect until the termination of the service agreement. Certain provisions may remain effective even after termination.

Article 4 (Company Information)

Article 5 (Posting and Amendment of Terms)

  1. The Company will post these Terms as a menu item on its website or other service platforms to ensure users can easily access and review them.
  2. The Company may revise these Terms, individual service agreements, or policies as necessary, provided such changes do not violate applicable laws (e.g., the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection).
  3. If changes are made, the Company will notify users by posting the revised Terms and reasons for revision on its service notice page at least 7 days prior to the effective date (30 days for significant changes). For unfavorable changes, the Company will also notify users individually via email, electronic message, login pop-up, or mobile message (SMS/LMS).
  4. Users who do not explicitly reject the revised Terms before the effective date will be deemed to have agreed to the changes. Users may reject the revised Terms by terminating their agreement with the Company.
  5. If a user does not agree to the revised Terms, the Company may terminate the agreement with the user.
  6. Revised Terms will take effect on the designated effective date and apply prospectively.

Article 6 (Individual Service Terms and Supplementary Rules)

  1. The Company may establish individual terms for specific services, subject to user consent.
  2. In cases of conflict, individual service terms take precedence over these Terms.
  3. Matters not covered in these Terms shall be governed by individual service terms, the Privacy Policy, relevant laws, or general practices.

Article 7 (Notifications)

  1. Notifications to users will be sent via the email address provided by the user (including SNS accounts linked to the user).
  2. For unspecified users, notifications may be posted on the service notice board or bulletin for at least 7 days. However, individual notifications will be provided for significant matters affecting specific users.

Chapter 2: Service Use

Article 8 (Formation of Service Agreement)

  1. A service agreement is formed when a user ("Applicant") agrees to these Terms, applies for membership, and the Company approves the application. Non-members who use the service are deemed to agree to these Terms.
  2. The Company may reject or terminate an application if the following conditions apply:
    a. Use of another person's identity during registration.
    b. Provision of false, inaccurate, or incomplete information.
    c. Prior termination of the agreement due to violations of these Terms, except when explicitly approved by the Company for re-registration.
    d. Other violations of Company policies or laws.

Article 9 (Content of the Service)

The Company provides flood monitoring services, including water level alerts.


Article 10 (Service Fees)

  1. Services are primarily free of charge. However, certain features or content may be offered as paid services.
  2. Pricing and payment methods for paid services will be posted in service notices.
  3. Any changes to service fees will be notified at least 30 days in advance, and users may terminate the agreement if they disagree.
  4. Users are responsible for telecommunication fees incurred during service use, which are separate from service fees.

Chapter 3: Rights and Obligations

Article 15 (Company's Obligations)

The Company shall:

  1. Provide services continuously and securely.
  2. Protect users' personal information per applicable laws and the Privacy Policy.
  3. Address user complaints and provide resolutions promptly.

Article 16 (User Obligations)

Users must not:

  1. Provide false or misleading information during registration.
  2. Use others' personal data or accounts without authorization.
  3. Violate the intellectual property rights or other rights of the Company or third parties.

Chapter 4: Termination

Article 19 (Termination)

  1. Users may terminate the agreement at any time, with re-registration restrictions for 14 days.
  2. The Company may terminate the agreement if violations of these Terms occur.
  3. Upon termination, the Company will delete user information except as required by law.

Chapter 5: Miscellaneous

Article 21 (Liability)

The Company is liable for damages caused by its intentional misconduct or gross negligence. Users are responsible for damages caused by violations of these Terms.

Article 25 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of South Korea.
  2. Disputes will be resolved in the Seoul Central District Court.
